Top Ten Community Rules

 

  • All cars to be registered (2) maximum.
  • Guest parking maximum (7) days.
  • No parking along red curbs.
  • No jet skis, boats, campers, or large trucks.
  • No signs except "For Sale" or "For Rent." Bushes and shrubs neatly trimmed.
  • Improvements must be approved by architectural committee.
  • Put trash on curb on trash day; keep cans in rear of the house, out of sight when possible.
  • Pick up trash in your yard. Pets: always on leash and always clean up!

Rules and Regulations Governing Use of
Community Property and Facilities

Mariner's Landing Declaration of Covenants, Conditions, and Restrictions Article II, Section 1(f), establishes the right of the Association to establish uniform rules and regulations pertaining to the use of the Community Areas and the facilities located thereon, including the parking areas, and including the imposition of fines for the violation thereof.

The By-laws of Mariner's Landing Townhome Association, Inc. Article VII, Section 1(a), gives the Board of Directors the power to adopt and publish rules and regulations governing the use of the Community property and it's facilities, including the personal conduct of members and guests in the common area.

The Board now elects to exercise this power by establishing the following rules and regulations governing all community areas as defined in Article I, Section 5, of the Declaration or Article II, Section 2 of the Bylaws.

The purpose in creating these rules and regulations is to emphasize to all members of the community that we have an active association intent on keeping up our property values and making our community a nice place to live. Additions to these rules and regulations will only be made in writing and after notification of the membership.

Enforcement of these rules and regulations will be the responsibility of all members of the community. Each member is charged with reporting violations of the rules to the Board or the management company. Reporting infractions should not be looked at as a way to "get at" your neighbor but should be used constructively to ensure uniformity in the community and to prevent someone from taking advantage of the rest of the community. It would also be helpful if an infraction is noticed to "nicely" remind your neighbor of the rule or regulation. If we work together we can use this policy to make a better community for all.

The attached rules and regulations shall be followed by all persons, including all family of members, and the guests of members, of the Association.

1. Mariner's Landing is a private community. Solicitation is not allowed. Use of community property is for members only with the exception of guests of members, deliveries, contractors of the Association and representatives of the Association.

2. No vehicle without current registration plates or vehicle in a non-operative condition shall be parked in community parking lots.

3. Trailers, trucks, campers, boats, house vans, construction equipment, commercial equipment, jet skis, snowmobiles, and vans shall not be parked in community parking lots. Except that small trucks and vans having a rated capacity of not more than 3/4 ton may be parked in designated spaces.

4. Commercial automobile repair shall not be allowed in community parking lots.

5. All members shall register, with the Board of Directors, any pets which will be permitted in the community areas. Owners shall also be responsible for ensuring their pets are inoculated and registered as required by law.

6. The Board of Directors shall have the right to order any person whose pet is a nuisance to remove such pet from the community area and the Board will have the exclusive authority to declare a pet a nuisance.

7. Pets shall not be permitted in the community areas unless accompanied by the owner and unless they are leashed. Owners shall also clean up after their pets have "soiled" community areas.

8. Trash placed on the curb for collection shall be in covered containers and shall not be placed at the curb prior to 6:00 PM the night before a scheduled collection. Empty trash containers shall be removed from the curb as soon as possible but no later than midnight on the day of collection.

9. Each member shall register vehicles parked in community parking lots with the Board of Directors. A maximum of two (2) vehicles per unit will be allowed. The Board shall maintain a list of authorized vehicles. Any unauthorized vehicle will be subject to being towed at the owner's expense.

10. Parallel parking along the curb shall be reserved for short term guests. No parking is allowed in front of the mailboxes. Other "No Parking" areas will be marked and enforced by the Board.

Any violation of these rules and regulations will be subjected to a fine of $25 for the first offense. A second violation of the same rule will be subjected to a $50 fine. Any subsequent violation of that rule will be fined at the rate of $100 per day until the violation is corrected.

This policy will be enforced within the following guidelines:

Upon notification of a violation the Board of Directors will issue a written "notice of violation" indicating the type of infraction, the pending penalty, and the amount of time given to correct the infraction.

If the infraction is not corrected a second notice will be issued notifying the member of the next scheduled meeting of the Board of Directors. At this meeting the "infractions committee" shall make a recommendation to the Board concerning imposition of the fine. The member in violation may present a defense at this meeting.

If the fine is imposed a bill will be issued by the management company.

The Board of Directors reserves the right to enforce these rules and regulations to the fullest extent of the law. The Board of Directors also reserves the right under Article III, Section 2, of the By-Laws to suspend the voting rights or rights to use the facilities of the Association, of a member who violates these rules and regulations.

The Board of Directors also wishes to call your attention to the Declaration of Covenants, Conditions and Restrictions which apply to members of this community. Article VI, restrictions on use, outline a number restrictions which will also be enforced by the Board of Directors. Some of these restrictions are repeated below for emphasis.

1. No profession or home industry shall be conducted unless permitted by zoning regulations and other applicable laws.

2. No noxious or offensive activity shall be carried on upon any lot or in the common area nor shall anything be done thereon which may become a nuisance to neighbors.

3. No roof top antennas or radio transmission antenna shall be erected on lots or in the common areas.

4. Trash, garbage or other waste shall be kept in sanitary containers and such containers shall be stored so as not to be visible from the streets.

5. No structure of a temporary character, tent, trailer, garage shed or other out building shall be permitted on the property. Requirements concerning the construction of small tool sheds can be found under #9.

6. No sign of any kind shall be displayed to the public view on any lot, except that one sign of not more than four (4) square feet shall be allowed to be placed on a lot advertised for sale or rent. Only signs authorized by the Board may be erected in the common areas.

7. The maintenance, keeping, breeding, boarding, and/or raising of livestock or poultry of any kind shall be and is hereby prohibited, except that the keeping of domestic dogs and cats will be allowed. Maximum two (2) pets per unit.

8. The Board of Directors shall have the right to enter upon any lot and trim or prune, at the expense of the owner, any hedge or planting which, in the opinion of the Board, is unreasonably detrimental to the adjoining property or the community.

9. Any improvement to any lot or to the structure on any lot must be approved prior to work being done by the Architectural Committee of Mariner's Point Community Association. These improvements include, but are not limited to, the building of fences, walls, decks, patios, storm doors, security lights, electronic insect traps, storage sheds, swimming pools, awnings, trellises, hot tubs, changes in lot drainage and landscaping improvements.

10. No clothing, laundry, or wash shall be aired or dried on any portion of the lots in any area other than rear yards of lots.
